Rixor.io Terms and Conditions

These Terms and Conditions govern access to and use of Rixor.io, a SaaS platform for conversations, CRM, automation, artificial intelligence, conversational marketing and commercial tools connected to channels such as WhatsApp, Instagram, Facebook Messenger, Telegram, email, calls and other compatible services.

By creating an account, contracting a plan, accessing the dashboard, connecting channels, using automations or using any feature of Rixor.io, you accept these terms on your own behalf or on behalf of the company you represent.

If you do not agree with these terms, you must not use the platform. Continued use of Rixor.io implies acceptance of any updates published on this page.

Rixor.io allows centralizing conversations, organizing contacts, managing commercial opportunities, running campaigns, automating flows, using AI agents, measuring results, connecting integrations and managing commercial teams from a single platform.

Features may vary depending on the contracted plan, technical availability, country, connected channel, external provider, Meta policies, WhatsApp Business Platform, messaging services, payment gateways or third-party integrations.

Rixor.io may add, modify, limit or remove features to improve stability, security, legal compliance, performance or product experience.

The user is responsible for maintaining the confidentiality of their credentials, accesses, tokens, API keys, connected accounts, internal users and permissions configured within Rixor.io.

All activity performed from an account will be considered performed by the account holder or by users authorized by them. You must notify us immediately if you detect unauthorized access.

Rixor.io may suspend, limit or block accounts when there are reasonable signs of fraud, abuse, security risk, legal non-compliance, non-payment, spam, impersonation or prohibited use.

Access to Rixor.io may be subject to free plans, trials, monthly plans, annual plans, add-ons, AI credits, additional users, contact limits, message limits, automation limits or premium modules.

Prices, limits, taxes, commissions, third-party charges and commercial terms are shown on the pricing page, quote, contract or corresponding invoice. Unless expressly indicated, prices are in US dollars.

The user authorizes Rixor.io or its payment processors to charge the amounts corresponding to the selected plan, renewals, extras, usage charges, consumed credits, additional channels or contracted services.

Payments are non-refundable unless applicable law requires otherwise or there is a written commercial policy issued by Rixor.io.

The user agrees to use Rixor.io only for lawful purposes, legitimate commercial activities and in accordance with applicable laws, external provider policies and rules of each connected channel.

It is not permitted to use Rixor.io for spam, phishing, fraud, impersonation, sending deceptive content, harassment, unsolicited messages, unauthorized scraping, malware distribution, exploitation of vulnerabilities, illegal activities or violation of third-party rights.

The user is responsible for obtaining consents, permissions, opt-ins, legal bases and authorizations necessary before sending messages, campaigns, templates, calls, emails, SMS or any automated communication to their contacts.

Rixor.io may integrate with external services such as Meta, WhatsApp Business Platform, Instagram, Facebook Messenger, Telegram, email providers, SMS, calls, payment gateways, AI services, analytics, hosting, domains, APIs and other third-party tools.

The functioning of these integrations may depend on rules, availability, technical changes, approvals, limits, costs, reviews, policies and decisions of said providers.

Rixor.io does not control or guarantee the permanent availability of external services. The user agrees to comply with the conditions, usage policies, messaging policies, commercial rules and terms of connected providers.

Rixor.io may offer AI features, predictive scoring, assisted responses, intent classification, automations, commercial suggestions, predictions, summaries, conversational agents and operational recommendations.

These features are designed to assist the user, not to replace human judgment. The user is responsible for reviewing, approving, supervising and controlling the communications, business decisions and automated actions generated or suggested by the platform.

Rixor.io does not guarantee specific results in sales, conversion, revenue, savings, deliverability, template approval, campaign performance or absolute accuracy of predictions.

The user retains ownership of the data, contacts, conversations, files, configurations, campaigns, content and records they upload or generate within Rixor.io, subject to the licenses necessary to operate the service.

Rixor.io processes data to provide, maintain, protect, improve and support the platform, in accordance with its Privacy Policy, applicable data processing agreements and current laws.

The user declares having sufficient legal basis to collect, store, process and communicate personal data of their customers, leads, users, employees or contacts through Rixor.io.

Although Rixor.io implements reasonable security measures, no internet-connected system can guarantee absolute protection against incidents, unauthorized access, failures or interruptions.

The user is responsible for the content of messages, campaigns, templates, ads, forms, files, images, texts, automatic responses, flows and any material sent or published using Rixor.io.

The user guarantees that their content does not infringe copyrights, trademarks, privacy, image, confidentiality, intellectual property, advertising regulations, industry rules or third-party rights.

Rixor.io may remove, limit or block content when it reasonably considers that it violates these terms, affects security, damages the service's reputation or violates third-party policies.

Rixor.io, its software, brand, interfaces, design, features, models, flows, documentation, components, structure, code, technology, logos and visual elements belong to Rixor.io, Repku LLC or its licensors.

These terms do not grant the user ownership of the platform, but a limited, revocable, non-exclusive, non-transferable license subject to compliance with these terms to access and use the contracted service.

The user may not copy, modify, distribute, sell, sublicense, reverse engineer, commercially exploit or create derivative works based on Rixor.io without written authorization.

Rixor.io will seek to maintain stable and secure operations, but the service may be affected by maintenance, updates, technical failures, external providers, internet, connected channels, force majeure or events beyond reasonable control.

Support, response times, service channels, priorities, onboarding or technical assistance may vary depending on the contracted plan or specific commercial agreements.

Rixor.io may perform technical changes, migrations, improvements, security patches, updates or infrastructure adjustments to protect and optimize the platform.

The user may cancel their subscription according to the conditions of the contracted plan. Cancellation prevents future renewals but does not automatically eliminate pending obligations, already generated charges or overdue amounts.

Rixor.io may suspend or terminate access if the user violates these terms, does not pay, violates laws, abuses the service, affects third parties, generates technical risks or violates policies of connected channels.

After termination, the user must export the information they need within the available period, if applicable. Rixor.io may delete or anonymize data in accordance with its internal policies, legal obligations and applicable agreements.

To the maximum extent permitted by law, Rixor.io will not be liable for indirect damages, loss of revenue, loss of opportunities, data loss, interruptions, channel blocks, template rejections, provider decisions, unmet commercial results or misuse of the platform by the user.

Rixor.io's total liability for any claim related to the service will be limited to the amount paid by the user to Rixor.io during the three months prior to the event that gave rise to the claim, unless applicable law provides another mandatory limit.

The user agrees to defend, indemnify and hold harmless Rixor.io, Repku LLC, its directors, employees, contractors, partners and providers against claims, losses, damages, fines, costs or expenses arising from use of the service, user content, legal non-compliance, violation of third-party rights or breach of these terms.

These terms will be interpreted in accordance with the laws applicable to the service provider, unless a mandatory rule of the user's country provides otherwise.

Before initiating any formal claim, the parties will attempt to resolve the conflict in good faith through written communication to Rixor.io's official contact channel.

When a contract, service order or commercial agreement signed with specific conditions exists, those conditions will prevail over these terms only in what is expressly agreed.

Rixor.io may update these terms to reflect legal, operational, commercial, technical, security or product changes.

When changes are material, Rixor.io may notify through the platform, email, banner, website notice or any reasonable channel.

Continued use of the service after the effective date of an update constitutes acceptance of the modified terms.
